1. Agreement to Terms

By accessing or using LinearCast ("the Service"), operated at linearcast.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Service Description

LinearCast is a cloud streaming platform that enables users to create and manage 24/7 live TV and radio streaming channels. The Service includes:

• Automated playout from video playlists (loop, shuffle, and sequential modes)
• Live RTMP ingest for real-time broadcasting
• External HLS source pulling with failover
• Multi-destination restreaming to platforms such as YouTube, Facebook, and Twitch
• Channel analytics and viewer tracking
• Video library management and storage

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must be at least 16 years of age to create an account and use the Service.

4. Acceptable Use

You agree not to use the Service to:

• Stream, upload, or distribute content that is illegal in your jurisdiction
• Infringe on the intellectual property rights of others, including broadcasting copyrighted content without authorization
• Distribute malware, viruses, or other harmful software
• Stream content that is defamatory, obscene, or promotes violence or hate speech
• Attempt to gain unauthorized access to the Service or its infrastructure
• Use the Service to send unsolicited communications or engage in any form of spam
• Circumvent or attempt to circumvent usage limits, rate limits, or security measures
• Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use provisions.

5. Content Responsibility

You retain ownership of all content you upload, stream, or transmit through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process, transcode, store, and deliver Your Content solely for the purpose of providing the Service.

You are solely responsible for Your Content and for ensuring that it complies with all applicable laws and regulations, including copyright and intellectual property laws. We do not monitor or pre-screen content, but we reserve the right to remove content that violates these Terms.

6. Subscriptions and Billing

6.1 Plans and Pricing

The Service is offered under tiered subscription plans. Each plan includes specific limits on channels, viewers, restream destinations, and other features. Plan details and pricing are displayed on our website and may be updated from time to time.

6.2 Payment Processing

All payments are processed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annual). You agree to Stripe's terms of service in connection with payment processing.

6.3 Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. We do not provide prorated refunds for partial billing periods. If you believe you were charged in error, please contact us within 30 days of the charge.

6.4 Plan Limits

Each subscription plan has defined usage limits. If you exceed your plan limits, we may ask you to upgrade to a higher plan or reduce your usage. We reserve the right to suspend channels or features that exceed plan limits after providing reasonable notice.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided on a "best effort" basis. We may experience downtime for maintenance, upgrades, or due to factors beyond our control.

We will make reasonable efforts to notify you in advance of planned maintenance that may affect service availability. We are not liable for any loss or damage resulting from service interruptions.

8. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by LinearCast and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, LinearCast and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

10. Account Termination

We may suspend or terminate your account and access to the Service at any time if you violate these Terms or if we determine that your use of the Service poses a risk to the Service, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export Your Content for 30 days after termination, unless the termination is due to illegal activity or a serious violation of these Terms.

11. Indemnification

You agree to indemnify and hold harmless LinearCast and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if that fails, through binding arbitration.
